Sunrise Agency provides AI-powered marketing automation, CRM configuration, lead follow-up, reputation management, appointment booking, and related services for small and medium-sized businesses. Services are delivered through white-label software platforms managed and operated by us on your behalf.
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of services.
To access our services, you must provide accurate, current, and complete information during registration and keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at contact if you suspect unauthorized access.
Our services are offered on a monthly subscription basis. By subscribing, you authorize us to charge your payment method on file on a recurring monthly basis at the rate corresponding to your selected plan. Current pricing is available on our Pricing page.
We may offer a complimentary database reactivation campaign or other trial services at no charge to demonstrate the value of our platform. These trial services are provided at our discretion and do not obligate you to purchase a subscription. We reserve the right to modify or discontinue trial offers at any time without notice.
You may cancel your subscription at any time by contacting us via our Contact page. Cancellations take effect at the end of the current billing period. We do not provide prorated refunds for partial months.
All fees paid are non-refundable except where required by applicable law or at our sole discretion in exceptional circumstances. Cancellation does not relieve you of the obligation to pay any fees accrued prior to the cancellation date.
You retain ownership of all data you provide to us, including customer lists, contact information, and business data. You grant us a limited license to use your data solely to perform the services described in these Terms.
We treat your client data as confidential and will not share it with third parties except as necessary to deliver services (e.g., sending SMS or email via our subprocessors) or as required by law.
You represent and warrant that you have obtained all necessary consents to provide us with any personal data about your customers and to send them marketing communications on your behalf. You are solely responsible for compliance with applicable privacy, anti-spam, and telecommunications laws with respect to your customer lists.
Our services are delivered through proprietary white-label platforms. You agree not to reverse-engineer, disassemble, or attempt to identify the underlying technology or third-party platforms we use to deliver our services. You also agree not to disparage, misrepresent, or publicly identify our technology stack without our prior written consent.
All content, branding, materials, workflows, templates, and systems created by Sunrise Agency remain our exclusive intellectual property. Nothing in these Terms transfers any ownership rights to you. You are granted a limited, non-exclusive, non-transferable license to use the deliverables we create for your business solely in connection with your use of our services.
You retain ownership of your own brand assets, logos, and proprietary content that you provide to us for use in your campaigns and automations.
You agree to use our services only for lawful business purposes and in compliance with all applicable laws and regulations. You may not use our services to:
We reserve the right to suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that you have violated this section.
Our services are provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or completely secure.
We do not guarantee specific results, revenue increases, lead generation outcomes, or booking volumes from use of our services. Marketing results depend on many factors outside our control.
To the fullest extent permitted by applicable law, Sunrise Agency and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, loss of data, or business interruption, arising out of or related to your use of or inability to use our services.
Our total cumulative liability to you for any claim arising out of these Terms or your use of our services shall not exceed the total fees paid by you to us in the three (3) months immediately preceding the claim.
You agree to indemnify, defend, and hold harmless Sunrise Agency and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of our services, your violation of these Terms, or your violation of any rights of a third party.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
We reserve the right to update or modify these Terms at any time. When we do, we will update the effective date above. For material changes, we will provide at least 30 days' notice via email or a prominent notice on our website. Your continued use of our services after the effective date of any changes constitutes your acceptance of the revised Terms.
